In May and June 1987, the tentative agreement was submitted
to IUP's membership for ratification.
Notice of ratification
elections was provided in the April 1987 IUP newsletter which
characterized the process as "a vote of confidence for the
negotiating ~omnittee".~
The tentative agreement was thereafter
ratified by a majority of the members of IUP.~
CONCLUSIONS OF LAW
The parties stipulated to the following issues in this caser5
1) Did IUP violate the Act by failing to make
the terms of the tentative agreement public as
provided in Section 20.17(4), Chapter 20, Code
of Iowa (1987)?
2) Did IUP's failure to ratify the tentative
agreement prior to March 15, 1987 constitute
a prohibited practice as outlined in Section
20.10(3)(a), Chapter 20, Code of Iowa (1987)?
3) If IUP has violated the Act, what is the
proper remedy?
Mr. Austin argues that IUP was statutorily mandated by Section
20.17(4) to make the terms of the tentative agreement reached with
the State public, and that its failure to do so constituted a
violation of the Act.
This argument calls upon the Board to
interpret the meaning of Section 20.17(4) which provides:
