it has committed a prohibited practice as defined in Section 20.10 - of the Act. Appearing  on  behalf  of  Daniel  Kelley  and  Iowa  United Professionals was Matthew Glasson, Attorney  at Law.  Mr.  Austin appeared in his own behalf.  The State of Iowa intervened in this proceeding through its representative, Lorenzo D. Creighton. FINDINGS OF FACT As  stipulated by the parties, the State of  Iowa [State] and Iowa United Professionals [IUP] entered into collective bargaining in the fall of 1986 to negotiate a collective bargaining agreement to be in effect July 1,  1987 through June 30, 1989.  At this time Daniel Kelley was president of  IUP and Mr. Austin was a member of the bargaining unit represented by IUP. In December 1986, a tentative agreement was reached on certain issues, primarily those involving contract language. These items were  submitted to the IUP membership  in January  1987 for input regarding wage and fringe benefit priorities. On  or  about  February  23,  1987  a  tentative  agreement  was reached between negotiators for the State and the IUP negotiating committee.  Several members  of  IUP Local 7 contacted Mr.  Kelley after  this  time regarding a  ratification election. Mr. Kelley failed to hold  such an election at that time and the prohibited practice complaint which is the subject of this hearing was filed
