Statement of the Case
David Knock, Administrative Law Judge. Pursuant to a petition
filed under Section 20.11 of the Public Employment Relations Act
[Act], Chapter 20, Code of Iowa, a hearing was held before me on
September 1, 1988 in Ottumwa, Iowa.
The prohibited practice
complaint alleges that Daniel Kelley, in his capacity as president
of Iowa United Professionals, failed to conduct an election for
ratification of a proposed collective bargaining agreement between
Iowa United Professionals and the State of Iowa in violation of
Section 20.17(4) of the Act and Rule 6.4(20) of the Public
Employment Relations Boardr
s [Board] Rules and Regulations. ' The
complaint further alleges that Respondent failed to make the terms
of the proposed collective bargaining agreement public, also in
violation of Section 20.17(4) of the Act. Respondent denies that
